Cookie Law

The EU Cookie Law, actually the e-Privacy Directive enforced by the Information commissioners Office!, was updated on 26 May 2011. We had a year’s grace to comply and now it’s time, however, the law has not ended up being as drastic as it was first reported to be because there are some exceptions and implied consent is allowed in some cases.

For many of our customers websites the only cookies in use are:

  • A session based cookie used by Microsoft.NET to manage sessions. In English, an id that is stored by your web browser memory so the website knows between pages to treat you as the same person. This cookie is deleted when the web browser is closed if not before. This cookie is required for use of the website and is non personal and as such is exempt from the law. 

  • If your website has a login area a similar Cookie to the one above is created to maintain the users login throughout the session. Again this cookie is required to provide the user the functionality they have asked for (i.e. logging in) so it is also exempt from this law. 

  • Cookies used by Google Analytics to track visitors visits and progress through the website for statistical reporting. Unfortunately these are not exempt but we think (we are not lawyers mind) that these can be covered by implied consent provided a clearly visible message is displayed showing that they are in use and linking to a section of the privacy policy covering in more detail what they are and do. 

If you are using cookies to collecting sensitive personal data then explicit consent is more appropriate. This can be gained via a variety of available JavaScript that can be incorporated into your website. These typically display an overlaid message about cookies and give the user a checkbox to opt in or out of cookies. If they opt out you will also need to make sure the cookies they opted out of are not used!

The booking part of our website makes use of two session cookies called ASP.NET_SessionID and MeracAuthCookie. These cookies contain no personally identifiable information and are necessary for website functionality. They are held temporarily in memory and deleted when the web browser is closed.

This is how we cover Google Analytics cookies in our Privacy Policy. Note you will also need to put a clear notice to the user that you are using Google Analytics cookies in this way and refering them to the Privacy Policy.

This website uses Google Analytics, a web analytics service provided by Google, to allow us to evaluate and improve how the website is used. Google Analytics sets various cookies to collect standard internet log information and visitor behavior information in an anonymous form.
